Terms of Service

1. Acceptance of Terms: By using the SMS Weather On Demand service (the "Service"), operated by Winter Wolf Digital LLC you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.
2. Service Description: SMS Weather On Demand provides on-demand weather forecasts via SMS. To make a request, you must send a text message containing your unique customer ID, a one-time passcode, and geographic coordinates to our designated service number. In response, you will receive a single text message containing the weather forecast.
3. User-Initiated SMS Consent: Your inbound text message to the Service constitutes your express consent for SMS Weather On Demand to send one (1) single, transactional SMS message (the weather forecast) in response. If you have an active usage based subscription beyond your free trial, you may also receive occasional administrative messages related to your account (e.g., payment status). The Service will not send you marketing or promotional text messages.
4. Your Responsibilities: You are responsible for all activity that occurs under your account. You agree to:
   • Provide accurate and current information.
   • Maintain the confidentiality of your customer ID and any passcodes.
   • Not use the Service for any unlawful purpose, to harass others, or to send spam.
5. Fees and Payments:
   • Service Fees: Access to the Service is subject to a subscription or usage-based fees beyond any free trial, as detailed on our application subscription creation page. You agree to pay all applicable fees.
   • Carrier Charges: You are solely responsible for all carrier-imposed fees. Standard message and data rates from your mobile carrier will apply to all SMS messages you send to, and receive from, the Service.
6. Disclaimers and Limitation of Liability:
   • Service Provided "As-Is": The Service and any weather data are provided "as-is" and "as-available." We source data from third-party providers and do not guarantee the accuracy, completeness, or timeliness of any forecast or information.
   • No Guarantee of Delivery: The successful and timely delivery of SMS messages depends on your mobile carrier's network and is not guaranteed. SMS Weather On Demand is not liable for delayed, undelivered, or misdirected messages.
   • Limitation of Liability: To the fullest extent permitted by law, SMS Weather On Demand shall not be liable for any indirect, incidental, special, or consequential damages (including, but not limited to, loss of data, loss of profits, or property damage) arising from your use of, or inability to use, the Service or your reliance on any information provided by the Service.
7. Termination: You may stop using the Service at any time. We reserve the right to suspend or terminate your access to the Service at any time, without notice, for any reason, including for violation of these Terms.
8. Changes to Terms: We may modify these Terms at any time. All changes will be effective immediately upon posting to our website or application. Your continued use of the Service after changes are posted constitutes your acceptance of the new Terms.
